When you book/reserve hotel/holiday accommodation on this site, your contract will be with the relevant Supplier. When booking travel arrangements your contract with your Supplier(s) begins when you receive the confirmation e-mail stating that we have received your order. Once the contract is made the Supplier(s) is/are responsible for providing the travel arrangements you have booked and paid for. In parties of two or more people the person who makes the booking accepts responsibility for making payment(s) to SmashHolidays for all members of the party.
Our business and the services we offer are governed by the applicable laws of England and Wales. No warranties and/or representations of any kind, expressed or implied, are given as to the compliance of the information shown on the Site, the services offered by us or the Suppliers, any information relating to such services and our business in any respect with any laws of any other country which do not, in any event, affect or apply to the same.
You agree to be bound by the following obligations:
- You must be 18 years of age or over and have legal capacity.
- You accept financial responsibility for all transactions made under your name or account.
- You guarantee that any information you provide about yourself or anyone else shall be true and accurate.
- The Site must not be used for speculative, false or fraudulent bookings.
- The transmission of threatening, defamatory, pornographic, political, or racist material or any material that is otherwise unlawful is expressly prohibited.
- The Site and any content may not be modified, copied, transmitted, distributed, sold, displayed, licensed or reproduced in any way by you, except that one copy of the information contained within the Site may be made for personal, non-commercial use..
Smashholidays acts as a service provider in the field of tourism, and regarding all the bookings you make using our website, smashholidays.com acts as an agent to supply hotel accommodation to you. All arrangements named in your booking, such as but not limited to accommodation, transfers and insurance are arrangements made between you and the principal supplier of those arrangements. The responsibility to fulfill the terms of these arrangements is incumbent upon you and the principal suppliers of those arrangements and is not the responsibility of Smashholidays.
The contract is subject to these booking terms and conditions, and all booking conditions will apply to each and every booking made with Smashholidays. Once the contract is made, it is the accommodation providers' responsibility to provide you with what you have booked and it is your responsibility to pay for the accommodation in full, on time.
All relevant documentation will be sent to you via email, it is important to check carefully all the details of your booking once you receive it. Smashholidays will not be responsible for any information you do not receive, as a result of your failure to provide a valid e-mail address.
If you want to cancel or amend your booking later, you may have to pay cancellation or amendment fees; these could be as much as the total cost of the accommodation booked. If your booking is more than 56 days away, you can pay a 20% deposit. This deposit is non refundable. The balance is due 56 days before your travel. Please note that all the outstanding balance must be paid before you travel or your booking will be can cancelled.
In very rare circumstances we will not be able to confirm your booking with the accommodation provider after you pay the booking value, in this case you will receive an email notification about this, and a payment back will be issued very soon. If we are able to confirm your booking, you will be contacted, payment will be taken and your accommodation email will shortly follow.
As we are acting only as a booking agent we have no liability for any of the accommodation arrangements and in particular any liability for any illness, personal injury, death or loss of any kind, unless caused by our negligence. Any claim for damages for injury, illness or death arising from your stay in the accommodation must be brought against the owner of the accommodation and will be under the jurisdiction of the law of the country in which the accommodation is based.
After registration, on arrival at the accommodation, you will be allocated a room. Please note: when checking-in after midnight, your room will be reserved from the previous day. You must also check out of your room at 11:00hrs on the booking departure date, unless otherwise stated on the accommodation voucher issued by us.
All accommodation ratings are provided by the accommodation suppliers and may not correspond to the official rating of the hotel. They are intended to act as a general guide to the standard of the facilities in the hotel. We do not guarantee any of the facilities in the hotel based on the star rating or description provided by the supplier.

Full Board: Breakfast, Lunch and Evening meal - no drinks.
All Inclusive: Breakfast, Lunch and Evening meal, unlimited snacks (as per each individual hotel's service) and also local alcoholic & non-alcoholic drinks.
VAT is included in the cost of all accommodation to countries within the EU. This is not reclaimable by VAT registered persons. Your payment will be handled by PayPal. This name may appear on your bank statement. If we suspect fraud, we reserve the right to cancel a transaction for security purposes. The special offers are subject to availability and supplier.
The services which make up your arrangements are provided by independent principals. Those principals provide these services in accordance with their own terms and conditions. Some of these terms and conditions may limit or exclude the principal's liability to you. Copies of the relevant parts of these terms and conditions are available on request from us or the principal concerned.
We will endeavour at all times to ensure that hotels make no changes to bookings that we have made with them. If, however, we are advised by the hotel that they have to change your booking or they are unable to provide the accommodation booked we will inform you as soon as possible before departure if we are able to do so. Under those circumstances we will endeavour to provide you with similar accommodation but if you do not choose to accept that accommodation you can cancel with a full refund. Please note, however, that we will have no other liability towards you in respect of any other services booked with third parties that may be affected by the accommodation change.
If, for whatever reason, we cannot contact you before departure or if a hotel (or supplier) is forced to transfer you to alternative accommodation when you arrive in resort, they will undertake to transfer you to alternative accommodation of equivalent rating to that originally booked and when that undertaking has been fulfilled neither they nor we will have any other liability towards you. Also note that no refund can be claimed if you stay at the accommodation for a shorter period than that for which you have booked.
The number of nights stated in the price online refers to the number of nights the accommodation has been reserved for you. Some flights may be night flights; when you arrive in resort your accommodation will only be available if you have reserved it for that night.
This website may contain links to other websites which are offered by partners of ours. We provide these links for your convenience only but we cannot accept any liability whatsoever arising in relation to any such other websites.
You must ensure that you have proper travel insurance in place. From time to time you may be linked via this website to a partner who will be able to supply information on insurance policies but you must use your own discretion when choosing an insurance provider.
We consider adequate travel insurance to be essential. Please read your policy details carefully and take them with you on holiday. It is your responsibility to ensure that the insurance covering your purchase is suitable and adequate for your particular needs/holiday. We do not check alternative insurance policies.
At the time of booking, all prices shown on our website are subject to availability. As we act as agent and are advertising product provided by third party travel providers, prices are subject to change at any time.
We guarantee that once you have made your booking, we will not increase the price of your accommodation this includes any changes to VAT or Government Taxes.
Please note: once you have agreed a price and made your booking this is the price you pay. If the price decreases, you are not entitled to the accommodation at the changed rate.
Different hotels specify different maximum ages for passengers to be classed as children, though the most common maximum child age is 12 years old at the time of travel, up to and including the day of departure.
Anyone above 12 years old will be considered an adult. If you are traveling with children up to 12 years old, only 2 children are allowed in one room.
All bookings are due for payment at the time of booking. However, if your arrival date is outside of 56 days from the booking date you will be given the option to either pay 100% or 20% (a deposit) of the purchase price at the time of booking, and the outstanding balance must be paid 56 days prior to your arrival. If you will pay by credit or debit card, we shall automatically process the payment at the time of booking in accordance with the above terms. You hereby give us your consent for this procedure. Failure of payment, due to unauthorized or improper use of the credit card, or any other reason, shall result in your booking being cancelled.
If we do not receive all payments due in full and on time, we are entitled to assume (on behalf of the principal(s) concerned) that you wish to cancel your booking. In this case, we will retain your deposit in order to cover our fees and the cancellation charge of the principal. If we do not cancel straight away because you have promised to make payment, you must pay the cancellation charges shown in "Amendments & cancellations"clause depending on the date we reasonably treat your booking as cancelled (on behalf of the principal(s) concerned).
Payment for incidental extras (e.g. mini bars, telephone charges, etc.) must be made directly to the principal before you check out.
As we act only as agent for the principal(s) concerned, we reserve the right to pass on to you in full all additional costs and charges of whatever nature imposed by the principal(s) in accordance with its own terms and conditions.
If you wish to make changes to a confirmed booking we will try to accommodate any such requests, but since there may not be availability on the date required we cannot guarantee to do so. If the requested cancelation/amendment can be made, fees will apply as follow:
If you wish to cancel: Cancellation from time of booking to 15 days prior to check-in: 10% of the booking value. Cancellation between 14 days and 8 days prior to check-in: 50% of the booking value. Cancellation between 7 and 0 days prior to check-in date: 100% of the booking value.
If you wish to amend : Any change 15 days or more before check-in: an amount of 25.00 GBP will be charged. Any change between 14 days and 8 days prior to check-in: 50% of the booking value. Any change between 7 and 0 days prior to check-in date: 100% of the booking value.
Fees will be increased by any costs that may be charged by the provider of the accommodation to us when the original booking is cancelled.
Please note that if the required amendment involves a change of hotel, the amendment will be considered to be a cancellation of the original booking and appropriate charges will apply.
If your booking is for more than one person and one or more members of the party canceled or amended it, the remaining members of the party may find that the cost of their accommodation changes to reflect the consequent under-occupation of the accommodation booked.
If you or any member of your party has caused damage to hotel property or has behaved in a way that caused danger or distress to other guests or hotel staff, they reserve the right to terminate your stay immediately and in those circumstances we will be under no further contractual obligation to you. Full cancellation charges will then be applied and neither the hotel nor Smash Holidays will have any further responsibility for you or liability towards you.
Moreover, if any member of your party causes damage to the hotel or to any other third party during your stay, Full payment for any such damage or loss must be paid directly at the time to the principal(s).
All communication and confirmations between the parties will be via emails.
If you have any complaints during your stay at the hotel, please try to resolve them immediately by reporting them to the hotel staff. If your problems are not resolved, you can contact the local representative whose details are listed on your voucher. If those problems remained unresolved, please call the agent through whom you booked your holiday in order that they can contact us. If you remained dissatisfied after your holiday ends, please write to your agent within 28 days of your return from your trip.
NB please bear in mind that we act only as agent for the principal(s) concerned and therefore cannot accept any liability for your arrangements. Any assistance provided in resolving a complaint in relation to any arrangements is provided on a goodwill basis and in our capacity as agent only.
If you have any special requests that do not form part of the standard accommodation services as described in this website (for example room location, bed type, adjacent rooms) please let us know, we will pass on all such requests to the relevant supplier, but unfortunately these cannot be guaranteed, these are purely requests. We will not contact you before you travel to inform you whether or not your requests are possible, you will find out upon your arrival at the accommodation. Furthermore if the accommodation provider is unable to meet such requests, neither we nor they can have any liability to you in this respect.
Every effort will be made by your tour operator or supplier to meet your request, however, special requests are only requests and not guaranteed.
Immigration, visa and entry restrictions may apply both in the EU and elsewhere for other nationalities, including other EU nationals, and British Citizens who have conditions on their entry to the UK. This agreement is governed by the laws of England, Scotland and Wales, and all disputes arising under or in connection with it shall be referred to an English, Scottish or Welsh Court, dependent upon the location of the claimant in each instance.
